Largest e-commerce company, Flipkart to pay Rs. 15000 for delivering a defective mobile charger to a customer. A district consumer forum has directed the company to repayment for selling of a faulty mobile charger that damaged the customer’s phone.

Dr. Ahmed AQ Irfani, purchased a mobile battery charger at Rs. 259 from Flipkart in January this year. When he plugged the mobile charger to the power socket and connected the charger’s cable into his mobile phone, the wires burnt in less than 10 minutes and also damaged the phone.

“When I complained to Flipkart , they offered to replace the faulty charger, but declined to compensate for the damage caused to my phone. They suggested that the device could have been damaged because of surge in power, “ said Irfani. It was clearly mentioned on the charger that the capacity of the power fluctuations is ranging between 100 volts and 240 volts.

The company said that the device was damaged due to short circuit because of excessive current flow. They assured that there was no fault in the mobile charger. Irfan filed a petition about refunding of the payement and compensation and accusing Flipkart for lack in service.

“When the battery charger had a wide range of 110 volts to 240 volts, it is not probable that the power surge would have damaged the mobile phone. In such facts and circumstances of the case, the complainant is entitled not only for the refund of the amount paid for the charger but to a reasonable compensation.”

“Flipkart cannot shirk their liability on the grounds that they did not charge any consideration from the complainant. The complainant purchased the product through Flipkart and therefore there exists a relationship of a consumer and the service provider between the two,” said the bench.
